FOX Rocks Rothbury Contest Rules

    SOUTHFIELD, Mich. - These are the official rules for the FOX Rocks Rothbury contest:

    Who Can Enter

    1. Entrants must be legal residents of Michigan who are 18 years of age or older and have lawful access to the Internet with a valid e-mail address.

    2. Employees of Fox Television Stations, Inc., AEG LIVE (collectively, “Sponsor”), and their affiliated companies, and the advertising and promotion agencies of each, and the immediate family members of such employees, are ineligible.

    How To Enter

    1. No purchase is necessary to enter or win. Only one entry per band and no person may perform in more than 2 band entries. The contest begins when posted on April 27, 2009, and all entries must be received by 11:59 p.m. local time on May 24, 2009.

    2. To enter, access the on-line contest entry form at www.MyFOXDetroit.com and follow all instructions to complete the on-line contest entry form and to upload a jpeg photo of your band plus ONE 4 minute or less MP3 audio file of your band performing an original song. A band may consist of 1 person or a group of up to five members. By entering the FOX Rocks contest you represent and warrant that 1) the song you submit is an original composition by 1 or more members of your band, 2) all authors of the song have given their consent to its posting, and 3) all members of your band are 18 years of age or older. All songs must conform to MyFoxDetroit.com’s then-current standards and practices and policies as established or determined by WJBK in its sole discretion. Without limiting the foregoing, songs may not contain profanity, references to violence or demean any gender, race, religion or sexual orientation. Entry only becomes official after entrant has received a confirmation e-mail from FOX 2. Sponsor reserves the right to disqualify any entrant or remove any entry based on any claim of a third party, including, without limitation, a claim of copyright infringement or misappropriation of likeness. Entry constitutes an unlimited perpetual license to Sponsor to use the entry materials, including, but not limited to, the right to copy, distribute, publicly perform and display the entry materials on its websites, television stations and in any and all media whether now known or hereinafter invented. Except where prohibited by law, entry constitutes permission to use winners’ names, hometowns, likenesses, and photographs for online posting, and/or any advertising and publicity without additional compensation.

    Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry, winner(s) or other giveaway information by Sponsor or entrants for any reason whatsoever. Sponsor is also not responsible for any injury or damage to any entrant’s or any other person’s computer related to or resulting from playing or downloading any materials in the giveaway or for entries that are late, misdirected or incomplete. All entries become the property of Sponsor and will not be returned. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE GIVEAWAY IS A VIOLATION OF THE CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to cancel the giveaway if it becomes technically corrupted.

    3. SELECTION OF WINNER: All eligible contest submissions will be posted online at www.MyFOXDetroit.com from May 27, 2009, through 11:59 p.m. local time on June 21, 2009. The winning band will be determined by internet voting in accordance with voting rules announced at the time votes are solicited. The band with the most votes will be the winning band. Sponsor reserves the right to cancel the contest, or, at its option, to select the winner by alternate means if, in Sponsor’s discretion, the voting becomes technically or otherwise corrupted. In the event of a tie; FOX 2 will select the winner by random drawing from among the top vote generating bands.

    The Prize

    1. The winning band will receive the opportunity to perform at the Rothbury Music Festival which includes: a 40 minute slot to open the festival on the Sherwood court stage at @6:30 pm on Thursday July 2, 2009; a 15 minute slot at about 5:15 on the main stage, the Odium, on July 3, 2009. Plus the band will receive a total of 11“all access” artist credentials and a V.I.P. camp site to accommodate 11 people in a reserved area for band and staff. Approximate value of the prize package is approximately $798 per person or a total of $8,778 dollars. In the event the concert for which the winner is schedule to perform is cancelled or postponed, the performance portion

    of the prizing may be cancelled without substitution or compensation therefore. Other restrictions may apply.

    2. The winning band’s representative member will be notified by phone on June 22, 2009. All members of the winning band will be required to sign and return an Affidavit and Release within 3 days of the date of notification or the entire band will be disqualified. If the band’s representative cannot be reached, the prize will be awarded to the band that received the second highest number of votes.

    3. Prizes cannot be redeemed for cash or substituted for any other items by the winner. The winner cannot assign or transfer prize. Sponsor reserves the right to substitute a comparable prize of like or greater value, including cash, for any prize, for any reason.

    4. Each band must appoint one representative who must agree to be responsible for all local, county, state, and federal taxes on prizes based on the value of the prizes set forth in these rules.

    Miscellaneous

    1. Odds of winning depend on the number of bands entered and the number of votes received.

    2. Complete contest rules are available Monday through Friday during normal business hours at WJBK-FOX 2, 16550 W. 9 Mile, Southfield, MI 48075 through June 24, 2009, and at www.MyFOXDetroit.com.

    3. For the name of the winning band, send a separate, self-addressed, stamped envelope after June 24, 2009 to: FOX Rocks Winner c/o Box 2000, Southfield, MI 48037-0002.

    4. This giveaway is subject to all applicable laws and regulations and is void where prohibited or restricted by law, including without limitation, in jurisdictions requiring registration, filing, trust account, or posting of a bond, or any other requirements or disclosures that are not expressly satisfied by these rules. Sponsor is not responsible for typographical or other errors in the printing, offering, or administration of the giveaway, or in the announcement of the prize.

    5. By entering, participants represent that they are eligible, and agree (a) to be bound by these rules and the decisions of the judges, (b) to release Sponsor, its parent, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of any prize, and (c) to Sponsor’s use of entrants’ personal information as described in Sponsor’s Privacy Policy located at www.MyFOXDetroit.com.
