DETROIT (WJBK) - Schoolchildren chanted and marched in front of the Lincoln Hall of Juvenile Justice on April 13 shouting "mama knows best not CPS" and "Ariana should be home with her mother".
"I'm very hopeful that my daughter will be released today," said Maryanne Godboldo on her way inside.
The mother of 13-year-old Ariana is accused of barricading herself and the girl inside their home and firing shots at police when Child Protective Services workers came to take the child. Godboldo is facing criminal charges, but the case is on hold.
In this case, the state alleges medical neglect because Godboldo took her child off the drugs prescribed for her psychological condition.
"We're hoping that Ariana is returned home, this whole matter is released, because we don't think that the mother has done anything at all," said attorney Wanda Evans.
However, a judge ruled Ariana will remain at the Hawthorne Center in Northville until at least next week when she could be released to the custody of her aunt.
"She's a beautiful, intelligent, exciting, wonderful child, who is taking a lot of wear and tear over this situation," said aunt Penny Godboldo.
While at the center, Ariana has not been medicated. She's stable and acting normally, proof her family says that her mother has done nothing wrong. They also say Ariana has a prosthetic limb that needs to be refitted to her leg, and she needs to be with family.
"We have to continuously fight for Ariana, and we'll be victorious," said father Mubarak Hakim.
The judge said she would like to see the child placed with a relative if her doctors agree she can be medically discharged.
"I, again, question has all the things that DHS and CPS done truly been in the best interest of the child? I think not," said Penny Godboldo said.
The other big question is whether there was medical neglect. The judge has set a jury trial for June eighth, ninth and tenth on that issue. It will not be held at the Juvenile Hall of Justice, but rather in a courtroom downtown to accommodate all of those who would like to attend.
