DETROIT (WJBK) - The one teenager in custody for the bus stop shooting is released. Police accused Jamel Turner of being one of the shooters, but the prosecutor says there's not enough evidence to charge him.

FOX 2 was the first to catch attorney David Jones as he walked into the Detroit Police Department Northwestern District to pickup his client, Jamel Turner. The 18-year-old was a prime suspect in Tuesday's bus stop shooting that left seven teenagers wounded.

"Apparently they don't have enough evidence like I said yesterday," said Jones. He was right. 24 hours after Turner turned himself into police, Wayne County Prosecutor Kym Worthy decided there is not enough evidence to charge him. This despite the fact that police say witnesses picked Turner out from a photo lineup and claimed he was one of two gunmen who opened fire at a Detroit bus stop.

"They were very confident and brass, in my opinion, at the press conference yesterday about this being... the prime suspect. It went from that all the way to well maybe he was the driver. Now I'm hearing well maybe he knows somebody who was involved," Jones said.

Police took almost four hours to release Turner. When the 18-year-old finally walked out of the police station, he was reluctant to talk about his release. He kept walking while reporters asked him about his arrest and why prosecutors and police decided to let him go.

Finally, his attorney got him to turn around. They hugged and spoke to reporters, saying he's not involved in the shooting or affiliated with a gang. Turner claimed he didn't know what happened until police raided his family's home.

"I didn't know nothing about it until they came and knocked my door down," Turner said.

Currently, it is not clear if police had the right person or not. FOX 2 is told this is still under investigation and there was just not enough evidence to hold or charge Turner. That doesn't mean that he won't brought back into custody or charged in the future.

Jones is also concerned about the safety of his client and his client's family after all the attention that has been given to Turner, his family and his family's home. In fact, he even wrote a letter to the Detroit Police chief expressing that concern.

Meanwhile, It appears the Detroit Police Department is back to square one with this investigation and currently on the hunt for three suspects in the bus stop shooting.
