WARREN, Mich. (myFOXDetroit.com) - A woman says a police dog bit her, so she sued the police and the dog. However, her fight has fizzled.
It all started a couple of years ago with an arrest for disorderly conduct. The woman was found guilty, but then she turned around are tried to sue a police dog.
"I don't believe I ever heard of any other case in the country where a K-9 was named as a defendant in a lawsuit," said Warren Police Department Commissioner Bill Dwyer.
But it happened to Liberty, an eight-year-old German shepherd with the Warren Police Department. During a melee at a house in Warren a couple of years ago, police arrested a woman named Inez Stark for disorderly conduct. She claimed the dog bit her and then changed her mind.
"Twice recanted her statement as far as being bitten by the dog," Dwyer said.
Nevertheless, she filed suit against the dog, her handler, the police department and the city of Warren. The judge fined her attorney, Lawrence Radden, $500 for naming the dog as a defendant.
On Tuesday, the judge threw the case out. An appeal is planed.
