SOUTHFIELD, Mich. - Shortly after a seven-year-old Detroit girl was accidentally shot and killed by police, we learned there was a video tape of what happened as the tragedy unfolded.  Now, we are learning more about the person who shot that video.

You've seen the aftermath.  A front yard strewn with toys.  The home where seven-year-old Aiyana Jones was shot and killed in Detroit.  The police officer whose gun fired the shot told his supervisors it was a struggle between family that lead the bullet out of the barrel.

Attorney Gefforey Fieger says somebody who was with the Detroit Police Department or somebody who's associated with the department shot video tape of the whole incident that disputes the officer's claim.  A tape, Fieger says, a lot of people, including himself, have seen.  A tape, he fears, has been destroyed.

"I feel fairly confident that at least one or more police officers have seen that tape.  In fact, I have information to believe that former Chief Evans has seen that tape and knows that Weekely's claim about a struggle with the grandmother is a lie," said Fieger.

Who's lying and who's not?  That's what Michigan State Police are investigating now.

Fieger says a man came to his office and showed him that videotape, which shows a gun being fired from the outside before even entering the home.  He believes State Police are in touch with the person who showed him the tape.

So, who is this guy who showed Fieger the tape?

His name was John," he said.  "The prosecutor's office can give you further information on this gentleman."

Fieger hopes the Wayne County Prosecutor's Office will have charges for those involved with the shooting within a few months, although it's not clear if that's going to happen.

FOX 2 has calls into the Michigan State Police to inquire about the latest on this investigation and to ask them about this John person, who he is and what he has to show.

Also, the Department of Justice is looking into the Aiyana Jones case at the urging of Congressman John Conyers.
