PONTIAC, Mich. - It was a despicable crime when a group of teens tried to rob a lemonade stand in their own neighborhood. Turns out now, one of the accused is charged in another serious crime, but still he remains free.

"It outrages me. I mean, he has no remorse for anything he does," said Daniele Behan, who couldn't wait to give us a piece of her mind.

Behan's talking about 17-year-old Johntae Washington, who allegedly assaulted her while his buddies tried to rob her daughter's lemonade stand.

"Some people are just repeat offenders in the system and they're just criminal in nature," said Pontiac Police Sgt. Kevin Braddock.

It didn't take long. Washington did five days behind bars, and then several days later on Tuesday, another lady says he and other teens tried busting into a Pontiac home next door.

"They need to crack down on these kids and let them know they can't be out here breaking in our houses," she said.

What do you say to the judge, we asked Behan. She replied, "What are you thinking? He's got a criminal background. Why is he still free?"

Still free? That's right. After the second arrest, a Pontiac judge decided to let him out on personal bond even though before the lemonade stand he had three other prior arrests, including shoplifting and breaking and entering. Why? We called and visited the judge's house, twice, but she was nowhere to be found.

Next, we asked Washington if he feels he should be out right now. He answered, "Why you all asking me questions? Watch out cuz."

Over and over, he told us to "watch out cuz". We took that to mean he wasn't interested in doing any interviews.
