Tucker Cipriano and Mitchell Young both entered pleas of not guilty Tuesday in the brutal attack on Tucker's family. We're learning both of their attorneys want separate trials.
Mitchell Young was the first to be arraigned in Oakland County Circuit Court before Judge Shalina Kumar. It was a quick arraignment lasting no more than five minutes.
Young's attorney, Michael McCarthy, entered a plea of not guilty on the 20-year-old's behalf and requested additional time to file motions in the case, including a motion to have Young's statement to police thrown out.
"It wasn't a voluntary or an understanding statement, and so under the law if the court makes a determination, the judge here in the circuit court makes a determination that it wasn't, then that statement would be suppressed," the attorney said.
With Young gone from the courtroom, deputies escorted Tucker Cipriano into the room. His face gave nothing away.
Both men are facing charges of felony first-degree premeditated murder, attempted murder and armed robbery for the brutal attack that took place inside the Cipriano family home last April.
Tucker's father, Robert, was killed. His mom, Rose, and brother, Sal, suffered severe injuries.
The 19-year-old's attorney requested a mental health examination to determine if he is competent to stand trial. He wants to know if Tucker's drug use, including smoking Spice, could have played a role in the bloody beating.
"Tucker has a history of using other substances also and those substances could've adversely affected his mind. Voluntary intoxication is not a defense, but if those drugs caused him to be psychotic or caused him to be mentally ill, then that could become an issue during the trial," said attorney Mitchell Ribitwer.
Following the attack, Tucker Cipriano and Mitchell Young gave police various accounts of how events unfolded, at times pointing the finger each other.
Both attorneys want their clients tried separately.
Mitchell Young is due back in court on July 31. Tucker Cipriano is not scheduled back in court until September 4.
