    Detroit's police chief did his best to explain Monday what he describes as a tragic accident, the death of Adaisha Miller.  She was shot and killed early Sunday morning at the home of an off-duty officer.
    Detroit's police chief did his best to explain Monday what he describes as a tragic accident, the death of 24-year-old Adaisha Miller.  She was shot and killed early Sunday morning during a fish fry at the home of an off-duty officer.
SOUTHFIELD, Mich. (WJBK) -

"I don't think anybody intentionally shot her," attorney Gerald Thurswell said Friday.

However, he said the off-duty Detroit police officer whose gun went off during a party at his house is still responsible for the death of 24-year-old Adaisha Miller.  The young woman was dancing behind Officer Isaac Parrish when police say she grabbed his waist and his gun in a soft holster fired striking her in the chest.

"Officer Parrish was a veteran police officer.  He knows that a gun can kill.  He had the gun.  He is responsible and accountable for any damage that's caused, any injury that's caused, any death that is caused with the use of his gun," Thurswell said.

While police work to answer the many questions about how that gun went off, Thurswell is preparing a wrongful death lawsuit for the family.  He showed us the death certificate, which lists Miller's cause of death as homicide.

Earlier this week, the police chief called the shooting an accident.  Detroit Police Internal Affairs is still investigating while Parrish is on administrative duties.

"The officer knew the gun was concealed.  The officer knew no one could see the gun.  The officer knew the gun was loaded.  The officer knew there was no safety.  The officer knew this was a party where people were dancing and having fun," said Thurswell.

Visitation for Miller runs until 8:00 p.m. Friday.  Her funeral is Saturday at 11:00 a.m. at Hutchinson Funeral Home on Seven Mile in Detroit.
