Lawyer for dead woman's family planning civil suit

DETROIT (AP) -

The family of a woman fatally shot by an off-duty Detroit police officer's holstered pistol is planning a civil suit.

Attorney Gerald Thurswell tells The Associated Press that he'll file a lawsuit in the slaying of 24-year-old Adaisha Miller.

Thurswell didn't say who will be named in the suit or when it will be filed. He was hired by Miller's family a few days after her July 8 death.

Police have said Miller "embraced" Isaac Parrish from behind while dancing during a backyard party at the officer's home. Parrish's was wearing his police-issued handgun on his waist, and it fired striking Miller once.

Thurswell says Parrish was responsible for the weapon and "clearly was negligent."

Parrish has been assigned to desk duty. The shooting remains under investigation.
