An upstate man is facing DWI charges after police stopped him for speeding past a school Tuesday afternoon.

It happened in New Lebanon.

Police say that Andrew Darcy, 30, was stopped at 2:41 p.m. near the Walter B. Howard Elementary School on Route 20.

Police say that Darcy had a blood alcohol concentration of .28%, which is three and a half times the legal level for driving.

He was arrested on speeding and DWI charges and is due back in court on Dec. 20, 2012.
