NYC judge nixes Union Square Park eatery

Posted: Updated:

NEW YORK (AP) - A judge has extended an injunction barring New York City's plan for a controversial restaurant in Union Square Park.

Manhattan Supreme Court Justice Arthur Engoron said the city needs permission from the state Legislature to go ahead with plans for the eatery on the north end of the square.

The Daily News says the judge also indicated that if the restaurant's opponents asked for a ban on the square's popular holiday market, his ruling "would not be in favor of the (city)."

There was no immediate comment from Urban Space Holdings, which runs the market, and Chef Drive Market LLC, which was chosen to run the restaurant.

The city said it planned to appeal.

Opponents say the restaurant would cater to wealthy New Yorkers only.
