It was one of those days Derrick Miller just couldn't win. First, defense attorney Jim Thomas hit him for covering for Kwame Kilpatrick, then he faulted him for testifying against the former mayor.
But that's just the way it goes when you testify against your best friend. Miller's attorney said he's taking it as it comes.
"He held his own. Listen. He's here. He knows what to expect. As a defense attorney, I've prepared him as to what he can expect and he's dealing with it," said Byron Pitts.
Thomas has called Miller an ingrate and a turncoat. On Friday, he pointed out that Miller once lied to the feds to cover for his old friend. He didn't even have to tell the jury how much times have changed. Miller is now one of the government's star witnesses.
Thomas hammered Miller for saying he went to Asian Village to get a bribe, then invited the mayor there and gave him the bribe in the bathroom. Thomas' point was if it was supposed to be a secret deal, then why did the deal go down in such a public place?
"There's nobody in this case who has completely clean hands," Pitts said.
Still, Thomas tried to score points by suggesting that Miller's testimony may have been skewed to win favor with prosecutors. He is facing up to ten years for taking a bribe, but he could get a sentencing break for his cooperation.
"Whether or not the cooperation flows into what the government wants, into their theory of the case, it's not our issue. He's here to tell it as he knows it and let the chips fall where they may," said Pitts.
Miller is due back on the witness stand Monday. He should expect a volley of hard questions from defense attorney Gerald Evelyn.
