    A federal appeals court has agreed to a defense request to remove the judge who was set to preside over the trial of accused gangster James "Whitey" Bulger.
    The judge who was set to preside over the trial of reputed gangster James "Whitey" Bulger was removed from the case Thursday by a federal appeals court that found his background as a former federal prosecutor could create the appearance of bias.

BOSTON (MyFoxBoston.com) – Judge Denise J. Casper is tapped to preside over the James "Whitey" Bulger trial.

U.S. District Judge Richard Stearns, who was presiding over the case, was removed Thursday.

Stearns was a top federal prosecutor in Boston in the 1980s when Bulger was allegedly working as an FBI informant. Bulger claims he received immunity for 19 murders from Jeremiah O'Sullivan, another federal prosecutor who worked in the same office as Stearns.
    
Whitey's defense team wanted Stearns removed because they claimed there was a conflict of interest and the 1st U.S. Circuit Court of Appeals agreed.
    
The trial is scheduled to start on June 6. It's still unclear if this new development will push back that date.
