PHOENIX (AP) - The Maricopa County Community College District says the state should have a judge review its policy barring some immigrants from receiving public benefits, including in-state tuition and driver's licenses.
 
The school district sent a letter to Arizona Attorney General Tom Horne Wednesday suggesting the judicial review.
 
The district has been caught in a tussle with Horne over its new policy granting in-state tuition to young immigrants participating in the Obama administration's deferred deportation program.
 
Horne has said the policy violates state law, which says immigrants with work visas are lawful residents. Youth in the Obama program do have work visas, but Gov. Jan Brewer says they are not lawful residents and therefore can't receive public benefits.
 
Other public colleges and universities in Arizona support lowering tuition for these students.
