Four Morehouse College athletes face charges

Four Morehouse College athletes are facing serious charges.  

According to the Fulton County Jail, two Morehouse basketball players, Malcolm Frank and Chukwudi Ndudikwa, have been charged with rape and aggravated sodomy. Tevin Mgbo, a basketball player at Morehouse, is charged with aggravated sodomy, kidnapping and reckless conduct.

Fulton County court documents show that the charges stem from in incident in April. An 18-year-old Spelman College student told people that she was raped by the men during a Spring Break party at an off-campus housing site.

The students were arrested in April and released on $10,000 bond within days, according to Fulton County Jail records.

FOX 5 has learned that the accuser told police she thought she had been drugged after drinking alcohol at party. Court documents show the woman had an eye injury when she reported the alleged rape to police.

The accuser made the allegations to the Morehouse Police Department.

Attorney Jackie Patterson, who represents Chukwudi Ndudikwa, says his client was there that night, but never had sex with the woman.

"She remembered people being present, so she obviously had to name my client who happened to be present, but she has no idea who or what happened to her because she was on these drugs," Patterson.

Frank's attorney, Keith Adams, also says that his client denies the charges.

"I understand that it's a serious allegation when a young lady says she's been sexually assaulted, but it's just as serious for them to arrest someone who has not committed a sexual assault," Adams said.

A former Morehouse football player, Lucien Kidd, is also facing rape charges in an unrelated incident on a different date.

Adams, who also represents Kidd, said that the alleged victim in that case and Kidd are acquaintances and were at Kidd's apartment.

"There's a period of time where they're alone in a room. She comes out, she has conversations with those same individuals after she would later allege that this assault had taken place. She waits for him, tells him to hurry up so she can get back to class and gives him a ride back to campus," Adams said.

Jail records show that Kidd was also booked on January 16, 2013 on unrelated charges including criminal damage to property and misdemeanor simple battery. He was released on $3,000 bond on January 17.

Morehouse College issued the following statement on Wednesday afternoon:

"In March, there were two alleged assault incidents involving Morehouse students.  After the information was brought to the attention of campus police, the suspects were identified and arrested.  While we cannot speak to specifics of these cases, our policies and procedures call for disciplinary actions against students who violate our code of conduct and the law, up to and including dismissal from the College.  Morehouse has a zero tolerance policy related to violence of any kind.  Violence is the very antithesis of the Morehouse ethos and the values of a Morehouse Man. Morehouse College police are working with the Fulton County District Attorney's Office and will continue to do so until these cases are resolved."
