Man accused of throwing dog over motel balcony

SMYRNA, Ga. -

A Smyrna man is accused of throwing a dog inside of a metal crate off of a motel balcony.  Hotel surveillance footage obtained by FOX 5 shows the alleged incident.

According to an incident report, 29-year-old Marcell Sibley said he had taken the dog downstairs to go to the bathroom. The dog didn't use the bathroom until they got back near the hotel room at the Allround Suites in Marietta. Sibley said he snapped and threw the dog, which was inside a metal kennel, over the second-floor balcony.

The arrest warrant says that the kennel shattered after it hit the ground. Sibley then allegedly went downstairs and threw both the kennel debris and the dog into the dumpster.

A bystander got the dog out of the dumpster, police said.

When police arrived, they say the dog was still alive, but was not moving and had blood on its mouth and her legs were broken.

"Animals are just like children. They're innocent and they're helpless and they really require all of our help to make sure that we care for them and take care of them, and when you see something as tragic as this, it really tugs at the heart strings," said Officer David Baldwin of the Marietta Police Department.

Sibley was arrested on Friday and is being held on $10,000 bond.  He is charged with felony aggravated animal cruelty.

The dog, a Yorkie, is reportedly in stable condition, but possibly has spinal injuries. She is being held at the Cobb County Animal Control.
