A-Rod attorney discusses malpractice lawsuit

NEW YORK (MYFOXNY) - Lawyers for the Yankees physician and New York Presbyterian Hospital have made a motion in court to move the medical malpractice lawsuit filed against them by NY Yankees star Alex Rodriguez out of the Bronx.

Rodriguez alleges Dr. Christopher Ahmad mishandled his medical care during the 2012 AL playoffs.

"They don’t want the Bronx jury to hear it as far as I’m concerned," said attorney Alan Ripka.

Ripka, who is representing A-Rod in the malpractice case and not in the arbitration hearings with Major League Baseball where A-Rod is fighting a 211-game suspension, says Rodriguez was given an MRI exam on Oct. 11, 2012, that revealed an injury to his left hip joint.

The suit filed in Octotber of this year said Dr. Ahmad of New York Presbyterian Hospital did not inform him of the tear and instead cleared him to continue playing. They say that caused Rodriguez "great pain."

The Yankees maintain that at the time, Rodriguez had been complaining only of a problem with his right hip, not the left one.

Rodriguez was suspended by MLB on Aug. 5 for alleged violations of the sport's drug agreement and labor contract, and the players' association filed a grievance to overturn the penalty.

When asked why the medical malpractice suit was filed while A-Rod awaits a decision on whether he'll be allowed to play for the Yankees next year, Ripka said one had nothing to do with another.

"They are independent of each other," said Ripka.
