Posted: Updated:
MORGAN COUNTY, Ga. -

A Morgan County man was arrested Saturday and charged with the death of a 9-month-old boy.

A spokesperson for the Morgan County Sheriff's Office tells FOX 5 News that the infant was transported to Morgan Memorial Hospital on Saturday afternoon after he reportedly fell from a couch and was unresponsive. The baby was later flown to Children's Healthcare of Atlanta at Scottish Rite for further treatment.

Deputies performed a search of the home where the fall occurred, located in the 1000 block of Aqua Road, after the child condition's was determined. This led to the arrest of man who was caring for the young child, 21-year-old Donald Justin Lee.

Initially, Lee was charged with cruelty to children. Police plan to upgrade those charges to felony murder after the baby boy was taken off life support on Sunday and passed away.

Lee is being held in the Morgan County Public Safety Center without bond.
