Judge denies request to step down from case

DETROIT (AP) -- A judge has denied defense attorneys' request to remove herself from a case of a Detroit-area man who fatally shot an unarmed woman on his porch last fall.

Wayne County Judge Qiana Lillard on Friday rejected claims by attorneys for Theodore Wafer that her previous employment with the prosecutor's office and associations with its employees create an appearance of impropriety.

That and other matters are now before Judge Timothy Kenny, who presides over the criminal division.

Wafer shot 19-year-old Renisha McBride at his Dearborn Heights home and is charged with second-degree murder. He believed McBride was trying to break in.

Prosecutors say Wafer should have called police instead of firing his gun. McBride was drunk and was in a car crash three hours earlier. Trial is set for June 2.
