Minnesota Man Says He Was Cited For Avoiding Pothole

Rosemount-MN- A Minnesota man says he ended up getting a ticket for avoiding a pothole.

That man is now fighting the citation.

“It shakes your vehicle so severely that you feel like you're going over a land mine. It feels like it's about to tear my truck apart,” Allen Moe said.

For more than two years, Moe has been going out of his way to avoid a string of potholes that rattle his car.

“It feels like it's about to tear my truck apart,” he said.

Now the only thing rattled are his nerves after he was cited for failing to stay in his lane.

“I swerved just to get around the potholes and then I came back into my lane. After I went through the stop light he stopped me,” Moe said.

The father says he was driving his girls to dance class when at one point the officer suggested he might have been texting, but the father of two insisted the swerving was deliberate to save this suspension.

“We all do it in this community. We have to preserve our own vehicles. And he didn't like that,” Moe said.

The pothole problem was caused by the type overlay done a few years ago.

In fact, even the mayor admits it's all you can do to avoid the potholes.

“That's what I do when I drive down this street also,” Mayor Bill Droste said. “It deteriorated so quickly here this winter that you have to drive around pot holes.”

Moe says he plans to fight the ticket, not because of the $128 dollar fine, but purely out of principle.

The road is scheduled to be resurfaced in June.
