Ruling states Conyers will not be on primary ballot

(WJBK) - An official made her final determination on whether longtime Congressman John Conyers should be on the Aug. 5 primary ballot.

Wayne County Clerk Cathy Garrett ruled Tuesday he will not be on the ballot.

Conyers' campaign was thrown into jeopardy because of multiple people collecting nominating petitions for him. Turns out they were not registered voters, which they were required to be as petition collectors.

As a result, the Wayne County Clerk said Conyers was more than 400 signatures short of the 1,000 needed to appear on the August primary ballot.

"It is on me. I double checked every person that signed those petitions and I was remiss in not checking the circulators regulation status," says Steve Hood. "I went on their word because they've been doing it for years."

Monday, labor activist Robert Davis sent a letter to the clerk asking her to put Congressman Conyers on the ballot or wait until a hearing in federal court.

Davis and the ACLU filed lawsuits saying the requirement that petition collectors be registered voters is unconstitutional and there's plenty of case law to back it up.

A hearing is set in federal court to determine if petition collectors have to be registered voters.

Garrett released a statement saying, "Although I am not the final arbiter, I eagerly await the court's review of the constitutionality of the laws and statutes pertaining to petition circulators."

Hood says he believes Conyers would win a write-in candidacy if the situation calls for it.
