PHOENIX (KSAZ) - The father of a baby who drowned Tuesday in a bathtub was charged with murder for his son's death. Now his family speaks out, saying he is a good father.

Phoenix Police say the case is clear; the father's actions led to his baby's death. The child's great-grandmother said the father should be at home, not in jail.

Prayer candles, balloons, and a picture of the 3 month-old boy named Phoenix are all part of the growing memorial in front of the house near 27th Ave. & Filmore.

The baby's father, 19 year-old Carlos Castillo appeared before a judge on charges of murder.

Investigators say Castillo put the baby in the bathtub and left him alone while he took a nap. The baby's great grandmother was also in the home when it happened, she says she didn't know Castillo put the child in the tub.

FOX 10 asked the great grandmother if she thought he should be charged. "No, because he never did that before, that's why. I can't explain it, because before he goes to work he takes him a bath, and kiss him, and feed him, and then he goes to work. He's been doing this for a month," said Rita Madrid.

Police say that Castillo put the baby in the tub with two other children, a 1 year-old and a 3 year-old.  They say that Castillo woke up to find water spilling over the tub into a bedroom, he found the baby in the water and not breathing.

The great-grandmother tried to give the baby CPR. "The only thing I know, I try to help him, to get him something to breathe, that's the only thing I know, it's hard," said Madrid.

At the site of the tragedy she says she isn't blaming Castillo, she calls him a good father.

In addition to 2nd degree murder, police also charged Castillo with two counts of child abuse, one count for each child that was allegedly left in the bathtub.

The judge set Castillo's bond at $180,000.
