Road rage shooting victim was father of two

GENOA TOWNSHIP, Mich. (WJBK) - Derek Flemming, a 43-year-old father of two, was on his way to pick up his children from the first day of school at about 3:30 Tuesday afternoon.

Their mom, his wife, Amy, was by his side when the 69-year-old driver of a Dodge Ram pulled out onto Grand River at the border of Genoa Township and Howell.

The family attorney for the Flemming family, William Moore, describes what Amy Flemming says happened in the moments before her husband was shot and killed at the intersection of Grand River and Chilson.

"They noticed a vehicle coming out from the right at them, they didn't think the vehicle was going to stop even. It finally it did, partway into Grand River. They went by it," Moore says. "The vehicle, being the guy who shot him, pulled out right behind him, so close they couldn't even see his headlights. They went to pull to the right to let him go by - he was already passing them on the right. They had to jerk back to the left. He pulled in front of them, slammed on the brakes."

Moore says the Flemmings got to the next light on Grand River at Chilson and that's where Derek Flemming made a fatal mistake.

"Derek got out and went up to the window and said, 'What's your problem?' and got shot," Moore says.

The suspect has been arrested.

Neither the sheriff's department nor the prosecutor is commenting on the case at this time, so it's still unclear what charges could be filed.
